ORA TEXT MESSAGE TERMS & CONDITIONS
From time to time, ORA may advertise the opportunity to participate in the Program. Users that opt-in may receive alerts and information from ORA through text messages. Program participants can expect to receive messages concerning marketing, abandoned cart reminders, new arrival messages, and/or special offers.
By opting in:
You authorize ORA to use autodialer (“ATDS”) or non-autodialer technology to send text messages to the mobile phone number associated with your opt-in. You do not have to opt-in or agree to-opt in as a condition of purchase.
You are signing your Opt-in Text Message Service.
You confirm that you are the subscriber to the associated mobile phone number or that you are the customary user of that mobile number and have authorization to opt-in.
If you do not wish to continue receiving text messages or no longer want to participate in this Program.
You agree to reply, “STOP”, “QUIT”, “END”, “CANCEL”, or “UNSUBSCRIBE” to any mobile message from ORA, where available, in order to opt out of the program.
You may receive additional SMS messaging confirming your decision to opt out.
Cost and Frequency:
Message and data rates may apply. ORA may send multiple text messages, recurring text messaging at any time with or without notice. Check with your wireless carrier for details on receiving text messages.
For support regarding the program, text “HELP” to the number you receive messages from our email us at email@example.com. Please note this email address is not an acceptable method to opt out of the program. Opt outs must be submitted in accordance with the procedures set forth above.
In the United States, compatible carriers include: AT&T, Verizon Wireless, T-Mobile, Sprint, MetroPCS, and others. This service may not be available on all carriers. Carriers are not liable to delayed or undelivered messages.
Our Disclaimer of Warranty:
The Program is offered on an "as-is" basis and may not be available in all areas at all times and may not continue to work in the event of product, software, coverage or other changes made by your carrier. We will not be liable for any delays or failures in the receipt of any mobile messages connected with this Program. Delivery of messages is subject to effective transmission from your service provider/network operator, and is outside of our control.
You may not use or engage with the Program if you are under thirteen (13) years of age. You agree that you are not under the age of thirteen (13) and that if you are a minor in your jurisdiction, you have received consent from a parent or guardian before joining the Program. By using or engaging with the Program, you also represent that you are permitted by your jurisdiction’s applicable law to use/or engage with the Program.
Duty to Notify and Indemnify:
If at any time you intend to stop using the phone number that has been used to subscribe to the Program, including cancelling your service plan, selling or transferring your phone number to another party, you agree that you will complete the Users Opt process set forth above prior to ending your use of the phone number. You understand and agree that your agreement to do so is a material part of these terms and conditions. You further agree that, if you discontinue the use of your phone number associated with this program without notifying ORA of such change, you agree that you will be responsible for all costs (including attorney’s fees) and liabilities incurred by ORA, or any party that assists in delivery of messages ORA sends, as a result of claims brought by individual(s) who are later assigned to that phone number. This duty and agreement shall survive any cancellation or termination of your agreement to participate in any of our Programs.
You agree that you shall indemnify, defend, and hold ORA, our affiliates, subsciatied, parents, members, agents, and any third-party service provider we use to send messages harmless from any claim or liability resulting from your failure to notify us of a change in the information you have provided, including any and all claims or liabilities under the Telephone Consumer Protection Act 47 U.S.C. § 227 or similar state and federal laws and any regulations promulgated thereunder resulting from us attempting to contact you at the phone number you provided.

To the maximum extent permitted by applicable law, you hereby agree that ORA shall not be liable for any direct, indirect, punitive, special, consequential, incidental, or any other damages of any type arising or resulting from or in any way relating to your use or inability to use this Program. ORA shall not be liable for actions or omissions of third parties, including but not limited to delays in the transmission of messages.
These Terms & Conditions shall be bound by laws if the State of New York, and any arbitration or judicial proceedings to enforce or interpret these Terms & Conditions hereof may be through only in the State of New York.
We reserve the right to change or terminate this Program in whole, or in part, at any time without notice. If we decide to change this Program, we may do so at any time without notice to you. We will post those changes. You acknowledge your responsibility to review this Agreement from time to time and to be aware of any such changes. By continuing to participate in the Program after any such changes, you accept this Agreement, as modified.
